By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

 ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are an adult in your state or province of residence, or that you are an adult in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

YOUR ELIGIBILITY

You must be an individual, 18 years of age or older. If you are under 18 years of age, you may use Marurumi Safaris only with the involvement of a parent or legal guardian.

YOUR RESPONSIBILITY

Before making reservations, it is your responsibility to read the fine print associated with your desired product including, but not limited to, the following sections: Pricing and its notice, Tour Itinerary, Package Includes, Package Excludes, Cancellation and Refund Policy, Terms and Conditions, Special Note, etc. And you herein state that you have read and fully understand the content of all fine print and will waive the right to dispute any part of it after your purchase.

Once you have completed your reservation, it is the customer’s responsibility to keep all contact information up-to-date.

TRAVEL INSURANCE

Marurumi Safaris strongly recommend our customers acquire insurance covering medical, trip cancellation, baggage, etc. Marurumi Safaris does not currently offer any travel insurance arrangements. Marurumi Safaris shall be exempt from any liability in the event of an accident resulting in, but not limited to, loss or damage of properties, injury to people, death during a trip, delays, irregularities, or other occurrences beyond its control. You agree that Marurumi Safaris will not be liable for any costs or damages arising out of a dispute or disagreement between you and any participating provider or a third party for anything that is in any way related to this site or the use of the information contained in this site, and you hereby expressively waive any such claim against Marurumi Safaris and its owner, members, officers, directors, employees, parents, subsidiaries, agents and representatives. Marurumi Safaris suggest that due to the Cancellation Policy for your tour and the unexpected events that can possibly occur, your party would benefit from purchasing Travel Insurance for your reservation.

TOUR AMENDMENTS AND CANCELLATION

Marurumi Safaris will try its best to make sure all the tour arrangements will be the same as planned. However, to ensure safe and secure tours, Marurumi Safaris reserves the right to make amendments including altering, postponing, and canceling tours due to weather, transportation, riots, and many other uncontrollable circumstances.

LANGUAGE

Tours are escorted by professional English-speaking tour guides and/or driver guides. In order to meet the language needs of the majority of passengers on a tour coach, tours and/or languages may be combined to enable the operation of the tours.

Travelers may request a guide who speaks a language other than English at an additional cost. The availability of such guides is subject to the destination’s availability, and the cost may vary based on the language proficiency of the guide and the duration of the service. The traveler must inform us of their language preference at the time of booking, and we will do our best to accommodate the request; however, we cannot guarantee the availability of guides speaking all languages.

PASSPORTS AND VISAS

You are responsible for obtaining any travel documents and/or verifying entry requirements necessary for each country of travel and/or transit on your selected tour itinerary. Entry laws differ with respect to travelers’ citizenship. Marurumi Safaris cannot obtain personal travel documents for customers or assume responsibility for notice of current requirements on any given country. You are responsible for any expenses incurred as a result of delays or itinerary changes related to your lack of appropriate travel documents.

You should strictly abide by the laws and regulations promulgated by the government of the visiting country including but not limited to immigration and Customs Laws and Regulations. Marurumi Safaris will not be responsible for any penalties due to your failure to abide by any regulations of the government of the visiting country.

PAYMENT POLICY

Please be aware all prices are offered in the currency of United States Dollars. Prices may vary due to availability. For example, prices may increase during holidays. All prices are subject to confirmation.

A deposit of 30% is required on bookings of any tour arrangement; the balance is to be paid 30 days after the commencement of the tour.

Payment in full is required where bookings are made less than 7 days before the tour begins. Further details about Marurumi Safaris’ payment practices are described in our payment Policy. Marurumi Safaris Payment Policy is part of this Agreement, and you agree that you have read and approved of all its content before making an online reservation.

TRANSPORTATION & DRIVER/GUIDES

We offer transportation in a range of vehicles, including  safari tour vans,Jeeps,Land rover, land cruisers, and coaches, based on the itinerary and the number of clients. As part of our commitment to providing an exceptional safari experience, we ensure that all clients are guaranteed a window seat during their safari excursion.

 DELEGATION OF DUTIES

Marurumi Safaris reserves the right to delegate any or all of its obligations under this agreement to third-party contractors or subcontractors without prior notice to the customer. The customer acknowledges and agrees that Marurumi Safaris shall remain responsible for the performance of the services and that any subcontractors engaged by Marurumi Safaris will be qualified and capable of performing the services. The customer further acknowledges and agrees that Marurumi Safaris shall not be liable for any act or omission of any subcontractor or third-party contractor engaged by Marurumi Safaris.

AMENDMENT, CANCELLATION, AND REFUND POLICY

Further details about Marurumi Safaris cancellation and refund practices are described in Amendment, Cancellation and Refund Policy. Marurumi Safaris Amendment, Cancellation, and Refund Policy is part of this Agreement, and you agree that you have read and approved of all its content before making an online reservation.

AIRPORT TRANSFERS/ FLIGHT INFORMATION

Flight information must be provided in order for the airport transfer services to be arranged. At our discretion, if flight information is not provided or provided last minute, your reservation will be noted as a self-transfer and no airport transfer services will be arranged. If you decide to self-transfer to the tour’s first night’s hotel, please inform us at your earliest convenience. If you opt out of a transfer service, you may reinstate the airport transfer service if notification to reinstate the service is given well in advance of the tour’s departure. Urgent requests to reinstate airport transfer services cannot be guaranteed. If a flight is delayed, Marurumi Safaris will attempt to arrange a later airport transfer service, however, this later service is not guaranteed. If an airport transfer service is not available and cannot be provided, all guests are responsible for self-transferring to the tour’s first night’s hotel.

CHARGEBACK POLICY

You hereby waive any objection you may have to your credit card payment in the event that a tour e-ticket and service are sent via email. Any attempt to charge back, refund, or return the funds in this situation will be considered a breach of these terms and will be subject to further legal action.

DISABILITIES AND MEDICAL CONDITIONS

We make reasonable efforts to accommodate the special needs of our travelers; however, we are not responsible for denying services to travelers who require specialized equipment or services that are not readily available or possible within the confines of the travel package. We strongly urge you to inform us in advance of any special needs or requirements so we can discuss any additional costs and ensure your needs are met to the best of our ability. By signing these terms, you confirm that you have disclosed any medical conditions or disabilities and that you have confirmed any special accommodations if required.

TERMINATION

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Kenya.
